    2006 Senate Bill 1 (Medical malpractice constitutional amendment)

    Introduced in the Senate on January 4, 2006, to place before voters a Kentucky constitutional amendment to add a new section permitting the General Assembly to limit noneconomic damages and punitive damages following successful claims of medical malpractice. The bill would provide for a statute of limitations on actions, and require alternative dispute resolution in cases involving health care providers licensed or certified by the Commonwealth. The bill would propose amending various parts of Kentucky’s constitution to conform

    Trial By Jury and the U.S. Constitution

    Just a thought. Our federal constitution provides for ther right to a jury trial. If we make people who are injured by the doctor's mistakes (and hospital too), then who are they accountable to and won't the state's medical system absorb any unpaid medical bills. Let me see if this makes sense. I make drugs. People need drugs. If I get sued for making bad drugs, I can't afford to make good drugs. So, let's limit my liability for bad drugs and make those who are hurt and can't work again etc. absorb this cost of doing business. Same goes for a car, a hair dryer, or anything else where in a civilized society we expect responsibility and accountability from EACH OTHER. Will the hospitals provide a discount for limitations of liability? "Amendment VII - Trial by jury in civil cases. Ratified 12/15/1791. In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law."

    Why make victims of the victims of medical malpractice

    We need to rename this bill to "Bad Doctors, Medical Facilities and Drugs Protection Act." Let's do what Florida did. They opened up the doctors records on lawsuits to the public and banned doctors that have more than 3 convictions for malpractice. Those doctors are leaving Florida and coming to places like Kentucky to practice their bad practices. Let's not make the victim of a medical malpractice a victim again.     SB 1

    This bill is the same BAD BILL that was attempted two years ago and again last year. The first thing we need to do is defeat this bill again and then vote the sponsers Senators and Represetatives that vote for this bill out of office. Any member of the Ligislature that is in Favor of taking away the Citizens rights to sue, how much and replace this with a Committee that decides whether the victim can sue sounds alot like communism. The Bill of Rights is not to be tampered with by any person including the legislature. BAD BILL

    ONCE AGAIN I AM DISAPPOINTED BY THE REPUBLICAN LEADERSHIP. THIS IS A SELL-OUT OF THE CITIZENS BY THEIR LEGISLATIVE REPRESENTITIVES. FIRST WILLIAMS IGNORES OUR STATE CONSTITUTION AND NOW THIS. IT IS TIME FOR HIM TO LEAVE.

    My Party has left me

    This coming election will be the very first time in my 40 years of voting that I will vote Democrat. My party has gone nuts and left me. I am still for the same things I always have been for but the Republican Party has changed and is run by an idiot in Washington and a scandal in Frankfort. Adios.

    Medical Malpractice Constitutional Ammendment

    Is there any commitment by the insurance companies that they would lower rates even if the bill does pass. The way it stands now it is a bad bill. It places the burden on the backs of those who have suffered because of others mistakes. The poor and middle class will suffer the most from this bill.

    No Welfare For Ins. Co.'s

    This bill comes up every year because it generates tons of campaign cash from insurance companies. There is absolutely 0 proof that this bill would lower insurance rates. In fact, the insurance companies won't even tell you it will lower rates. Medical malpractice "reform" only hurts the elderly, children, and stay-at-home mothers. If we can trust a jury with the death penalty, we can trust them with money! Hurray for those that opposed this law. Keep fighting to keep our rights!
