This statute does not need to be amended. If damages and attorney fees are removed as a remedy, the right of redress through the courts will be lost in many instances. Unconstitutional displays will sprout up everywhere. Let's keep public displays within the constitutional framework. Of necessity this sometimes takes a case by case analysis.

Clearly, the prohibition against awarding actual damages is unconstitutional under section 54 of the Kentucky Constitution.

This bill is wrong. Establishment clause cases are tough enough, and involve very politically charged issues. We don't need any furhter roadblocks. Limiting attornyes fees and costs effectively limits the citizens' access to the judicial system. There should be no barriers to a citizens right to justice, but Rep. Lee continues to try to legislate barriers to justice. Please do not vote for or support this Bill.
