Introduced by Sen. Ray S. Jones, II (D) on January 4, 2006, to eliminate the “duty to retreat” in some criminal situations. The bill would provide immunity from prosecution in certain use of force cases and provide that law enforcement can investigate claims of lawful use of force but cannot make an arrest unless there is probable cause to believe that the use of force was unlawful.
Referred to the Senate Judiciary Committee on January 6, 2006.
1) good idea [by Anonymous Citizen on January 20, 2006] Why should I retreat when I'm being attacked I have right of self defence. I also belive that family of criminal should have no legal recourse against a person defending himself.
If they are killed while commiting a crime or assualt against a person . They choose the action and paid the price.
It todays world I should have the legal right to protect my self, family ,others and my PROPERTY against assualt or theft. Reply
